Terms and Conditions
These Terms and Conditions shall apply to the Sky Sports Living for Sport programme and the use of the website located at www.skysports.com/livingforsport
This contract is with Youth Sport Trust and Sky UK Limited. Where we refer to "we/us" in these terms it means Sky UK Limited of Grant Way, Isleworth, Middlesex TW7 5QD and Youth Sport Trust, SportPark, 3 Oakwood Drive, Loughborough, LE11 3QF and "our" shall be interpreted accordingly. "you" means you, the user of the website and "your" shall be interpreted accordingly. "Users" means the users of the website collectively and/or individually as the context admits.
You must be a teacher or member of school staff authorised by your secondary school or education provider for its participation in the Sky Sports Living for Sport programme. Only schools in the United Kingdom and the Republic of Ireland may participate.
Sky and the Youth Sport Trust may change these Terms and Conditions from time to time and so you should check these regularly on the website. Your use of the website will be deemed an acceptance of the terms existing at that time.
1. Acceptable Use
You agree that any use by you of the website shall be in accordance with the following conditions:
1.1 You will not post or transmit through the website any defamatory, threatening, obscene, harmful, pornographic or otherwise illegal material or material which would violate or infringe in any way upon our rights or those of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience. You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive. Always treat other users with respect.
1.2 You will not post or otherwise make available on the website any material which you do not own or without the express permission of the owner of the material. By posting material to the site you warrant that you have obtained all the necessary consents to do so and to make it available to us for the purposes set out in these Terms and Conditions (This includes, for example, getting the consent of any person identified in a photo. Where the photo identifies a pupil you must have the consent of their parent or legal guardian).
1.3 You will not copy, download, reproduce, republish, frame, broadcast, transmit in any manner whatsoever, any material on the website except as is strictly necessary for your professional use within your school environment. You must only use the website with permission of your school. By signing up on the website you warrant that you have this permission and you are acting in the course of your employment.
1.4 You will abide by the specific rules of any competition or promotion that you participate in on or via the website.
1.5 You will not do anything that affects the operability or security of the website or causes unreasonable inconvenience or offence or disruption to our staff.
2 Third Party Websites
2.1 You acknowledge and agree that we are not responsible for the availability of any third party websites or material you access through the website.
2.2 We do not endorse and shall not be held responsible or liable for any content, advertising, products or services on or available from such websites or material.
Any dealings between you and any third party advertisers or merchants found on or via the website, including payment for and delivery of products, services and any other terms, conditions, warranties or representations associated with such dealings, are made between you and the relevant advertiser or merchant. Therefore, we are not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings.
3 Intellectual Property
3.1 All copyright, trade marks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. You are permitted to use this material or content only as expressly authorised in writing by us or our licensors. You will not, and you will not assist or facilitate, any third party to copy, reproduce, transmit, distribute, frame, commercially exploit or create derivative works of such material or content.
3.2 If you become aware of any such distribution or commercial exploitation, you agree to notify us immediately. You acknowledge that by posting materials on the website, you grant to us and our licensors and assigns an irrevocable, perpetual, royalty free, worldwide licence to use the materials both within the website and in any other manner. The licence extends to copying, distributing, broadcasting, and otherwise transmitting, and adapting and editing the materials.
3.3 You acknowledge and agree for us to provide you with information regarding relevant school initiatives run by Sky and the Youth Sport Trust. To opt out please email your request to firstname.lastname@example.org
4 Liability and Restrictions
4.1 Material which is posted on any bulletin boards or chat forums is written by users and we are not responsible for and do not endorse such material. We reserve the right to monitor the contributions made and may respond to or comment upon communications made by you and edit, refuse to post, or remove any content from the bulletin boards and chat forums at our absolute discretion. No failure to remove particular material constitutes an endorsement or acceptance of it by us.
4.2 We will not be held responsible or liable for the content, accuracy, timing or reliability of any information or statements contained within the website, or for statements, advice and/or opinions made or given by users on the bulletin boards and chat forums (except as required by law). If you have any claim arising from the actions or statements of another user, you agree to pursue such a claim only against that user and not from us.
4.3 We can only provide free T-shirts to schools on a first come first served basis while stocks last. T-shirts will be allocated automatically to schools following their completion of the planning process and to a maximum of 20 T-shirts per project. T-shirt size and colour will be subject to availability.
4.4 A half day Athlete Mentor Initial Visit is available to schools (not teachers) who are new to Sky Sports Living for Sport ie. schools (not teachers) that have not had an Athlete Mentor visit of any kind, or had an approved project since 2008. Initial Visits are available to schools throughout the school year. In order to receive an Initial Visit schools must complete the sign up process online.
A full day Athlete Mentor Project Visit is available to schools that have completed the project planning process online.
A half day Athlete Mentor Loyalty Visit is available to schools (not teachers) that have previously planned a project since 2008 and completed the planning process online.
All Athlete Mentor visits (Initial Visits, Loyalty Visits and Project Visits) are subject to availability. These visits will be allocated on a first come first served basis.
4.5 Secondary schools are only eligible for up to two of the above visits from one of our team of Athlete Mentors. We reserve the right to choose which Athlete Mentor makes each visit.
4.6 Closing date 2016/17 sign ups is 11th June 2017 and all projects must be completed by 31st July 2017.
4.7 We will endeavour to provide the website using all reasonable care. Except as required by law, we will not be responsible or liable for the quality, accuracy or fitness for a particular purpose of the website and do not promise that the material contained in the website, or any of the functions contained in the website or its server will operate without interruption or delay or will be error free, free of viruses or bugs, or is compatible with any other software or material.
4.8 Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, we and our associated companies and agents exclude responsibility and all liabilities arising out of or in connection with the Sky Sports Living for Sport programme.
5 Sign Ups and reactivation
5.1 You must be a signed up user to upload and download material from the website .When you sign up you will be asked to provide a user name and password. Your user name is your email address and should be unique to you and not the name of another person or entity. We may ask you to change your username in our absolute discretion.
5.2 After signing up, access to the restricted areas of the website will require you to enter your user name and password. Your password is secret and personal to you and must not be disclosed to any third party in any circumstances. You are responsible for keeping your password secure and confidential. You must take all precautions to prevent your details being used by anyone else to access the restricted areas.
5.3 If we reasonably believe that your user name and password are being used in any way which is not permitted or acceptable to us, we may cancel your account immediately without giving you any notice.
5.4 You may change your password or any other personal details that you notified to us at any time on website. Should you become aware that a person knows your password you should change it immediately. You must not store your user name and password on your computer and we would recommend that you do not keep it anywhere that is accessible by any other person.
5.5 When signing up on the website you must provide us with accurate, true and correct information about you and your school, and you must keep this information up to date. By signing up on the website you warrant that you have provided information that is true, accurate and correct.
6.1 You agree to indemnify us, and/or any of our affiliates and our and their officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these terms and conditions by you or any other liabilities arising out of your use of the skysports.com/livingforsport site.
7.1 We may immediately terminate your use of the website if you breach, or we have reasonable grounds to believe that you are likely to breach these terms and conditions, or you otherwise engage in conduct which we determine in our sole discretion to be unacceptable.
8.1 Your sign up is personal to the school and may not be transferred to anyone else.
8.2 All or any part of any term of this agreement that is found to be unfair or unenforceable will be treated as deleted and the remainder of the terms will continue to govern each of our respective obligations going forward.
8.3 Your use of the website is governed by the law of the country in which you live. If your address is in the UK or ROI, any disputes can be dealt with by any UK or ROI court that can lawfully deal with the case.
